Legal Question in Civil Litigation in Oregon

small claims court...............finding the person you want to sue

I loaned a ''friend'' some money. She moved to another state and I never heard from her again. I've searched all the ''free'' sites the internet has to offer. No luck. Any advice? She does have a professional license (licensed nurse) and also filed bankruptcy. I have not been able to locate her name on ANY public records search. Any help would be appreciated.

Re: small claims court...............finding the person you want to sue

First, if she filed bankruptcy and listed you on the bankruptcy, you no longer have a right to collect the money from her. In fact, by trying to collect or suing her in small claims court, you will have violated a court order that stopped you from trying to collect. This could subject you to fines or other sanctions.

If you were not listed in the bankruptcy or it occurred before you loaned her the money, then you have a right to collect.

You might be able to track her by the state licensing bureau. Most, if not all licenses require that the person licensed (licensee) keep the agency updated with addresses and contact information.

You may also want to check with other friends to see if any of them know how to reach her. If she owes you enough money, there are also various agencies that will track people and you might want to look into one of those. Many advertise on the internet (check them out carefully before you hire them) and others advertise locally in the yellow pages (you will want to check these folks out, too.)
