Can i sue someone for threatening my family, child and myself through text messages and messages left on my awnsering machine? Even saying he was going to have me raped

Yes, such verbal threats are both the tort of assault and the tort of intentional infliction of emotional distress. You can sue the person doing it. I would suggest first notifying the police. Remove and store the answering machine tapes.
