Legal Question in Immigration Law in Oregon

I have five children who have US citizenship. I have been living here for 15 years. Right now I am trying to divorce with my husband due to Domestic Violence problem but there is no criminal charge. Is there anyway I can get greencard? I am not employed. My job is taking care of my children. I wish I could find a job outside and bring money to home.

If your husband is a U.S. citizen, you can file under VAWA. If one of your U.S. citizen children is 21 yrs old, then s/he can file for you. Otherwise, I don't see an immediate option for you, unless the law changes.

Generally, one needs some sort of "sponsor", such as an immediate relative who is a U.S. citizen or greencard holder, or a U.S. employer, to have eligibility for a greencard. There are other types of eligibility as well, but far too much to go into in this forum.

You can always contact an Immigration Attorney, such as myself, to investigate potential options further.

Good Luck!
