Citizenship

My Sister's Boyfriend of 5 years was arreted Last Sunday.He was charged with a D.U.I He is a Illegeal citizen.

He is in jail and has his arraingment yesterday.He pleaded Not guilty and they are going to hold him in jail until his trial date on the 23rd of this month.

My question is are they going to Deport him? Can he ever obtain citizenship with this on his record? If he is deported does that affect Future ctizenship as well? They have a son together. I know that they should have been married a long time ago, but they never did. I am just trying to find out some laws to this and what we can do to try to keep him here. Thanks

This is not a citizenship issue, but I will answer. I don't know the boyfriend's status nor whether or not he entered the U.S. legally. A DUI, if his first offense, may not render him deportable. If his status is here without documents, that will render him deportable. If he entered with a visa, and he were to marry your sister, she can petition for him and he can apply for his green card. If he came into the U.S. without documentation, he will have to return to his country and consular process. good luck.
