Legal Question in Immigration Law in Oregon
Married to an illegal alien
My friend entered the country legally through a visa waiver program. He overstayed and therefore is currently illegal. He got married during that time. Will it be possible to get legal status through that marriage? Will he have to leave the country during that process and, if yes, is there a possibility he might not be able to come back in? If he does have to leave the country, how long will he have to be away for? Will his spouse get into trouble for harboring an illegal alien when paper work is filed, supposing he can become legal with paperwork?

Re: Married to an illegal alien
Your friend can obtain the permanent resident in the US if he marries a US citizen and file the applications properly.
The spouse won't get into trouble if all she did was marry your friend and let him stay.
Please have your friend call our office if he needs attorney's help.
