Legal Question in Immigration Law in Oregon

Marrying an illegal

Hello! My boyfriend and I want to get married but he is not legal here. We would live together and I would keep going to school and he would keep working. How could I legalize him? What are the requirements? He has been living here for 13 years illegally. He does not have a criminal background what so ever. Please reply back.

Re: Marrying an illegal

DID HE ENTER THE COUNTRY WITH INSPECTION [LEGALLY]? IF SO, YOU COULD FILE A SPOUSAL PETITION AND HAVE HIM ADJUSTED WITHIN THE UNITED STATES. IF HE ENTERED ILLEGALLY, THE CASE IS VERY COMPLEX AND YOU MUST CONTACT AN IMMIGRATION ATTORNEY FOR FURTHER DETAILS.

This depends upon whether he entered the U.S. legally with a valid visa/visa waiver program or not. If not, he'll need to eventually return to his home country to get his permanent residence through marriage to U.S. in conjunction with an extreme hardship waiver.

You may find detailed information here:

It's probably best to discuss this over the phone to get additional details.
