What is the process for my Fianc to become legal in the US?

My Fianc andI hae been together for 6 years, adn engaged for 4, we have 2 kids together. We want to get married but he lives in Mexico and I live here in the US. How long would I have to wait inorder to process papers for him?? Or is that even an option?? How long would he have to wait over there, after we are married??

Depending on your fiance's previous immigration history, he may be eligilbe for a fiance visa. He would have to wait in Mexico for the visa, and you would then have to be married in the US within 90 days of his entry, and then he would be eligible to file for his green card. Prior to filing anything with USCIS though, I urge you to speak with an attorney about the process to make sure that your fiance is eligible.

You can file fiance visa for him and get married once he comes to the US. Or you can get married in Mexico and file for green card or K3 visa for him.

Our office is in Beaverton, OR. Feel free to call in if you have further questions.

You can petition him as a fiancee. Once your fiancee petition is approved, it will be sent to the consulate, where he would have to go to an interview and then would be issued the visa to come to the USA. Once he's in the USA, you must marry within 90 days. If you get married over in Mexico, you can then apply for him as a spouse. The length of time will depend on which route you decide to take. Feel free to contact me directly in private so I can explain to you in more detail the process of applying for a fiancee or a spouse. We offer free initial consultations to Law Guru users. Good luck!
