Over Payment of Disability Benefits
My Insurance Disability Benefits are repaying an amount in a over payment by my disability plan insurer. I had an accountant reveiw the over payment amount and I'm told by calculating it by my SSA 1099's , it has been repaid. The Insurance company refuses to give me any copies of my files, to prove they have miscalculated my benefits. I have asked since 2005 for copies, and strangely now they want to cash me out. I want to sue them for mishandeling my benefits and denying me access to my files so that I can prove their wrong. My benefits should have started up according to the accountant I had reveiw their recalculation spread sheet they sent in 2003 and in using my SSA 1099's. They are short ,rude , uncoperative bunch . When I asked for copies the Insurers benefit representative told me '' My file is their property and I would have to get a subponea to get it'' That's a direct quote. I really would enjoy sueing the pants off them, for how the have wrongfully mishandled my disability benefits.
I live in Oregon and want the best attorney if I can sue.
