Legal Question in Intellectual Property in Oregon
Seeking Legal Advice: DMCA Notice and Potential Lawsuit - Website Copyright Issue
Dear Legal Professionals,
I am a website administrator from China seeking legal advice regarding a copyright issue with my website. Here is my situation:
Background:
I launched a content website in late October 2024
The website was hosted through Cloudflare's services
I am a Chinese citizen operating the website
Issue:
I displayed several copyrighted videos on prominent locations of my website
At the time, I was not fully aware of copyright regulations
Cloudflare sent me a DMCA takedown notice
I immediately removed all potentially infringing content upon receiving the notice
Current Situation:
The content creators are threatening legal action
They claim I:
Used their content without permission
Attempted to impersonate their brand
Generated significant traffic through their content
Questions:
What are my potential legal risks in this situation?
What steps should I take to protect myself?
How should I respond to the content creators?
What are my rights and obligations under international copyright law?
Could this lead to criminal charges or only civil litigation?
Additional Information:
All infringing content has been removed
I am willing to cooperate to resolve this issue
I have no prior legal issues or DMCA notices
I would greatly appreciate any legal advice or guidance on how to proceed with this situation.
Thank you for your time and assistance.
Best regards,

Hi,
You need to address these concerns to a lawyer in China. If you are a Chinese resident located in China, then the only IP laws that will matter to you are those in your own jurisdiction.
