Legal Question in Intellectual Property in Oregon
Stolen Graphics
I draw original graphics which I post to my website. They are not currently for sale but may be in the future. It's come to my notice that my graphics have been copied and are being used by another individual in thier email letters and website. This person has been told that I don't allow use of my graphics even for non-profit as it states on my site but continues to use them. They say that since I haven't contacted them in writing through the postal mail and since they are using my graphics non profit that they are not breaking any laws. My question is, what steps do I need to take to get them to stop using my graphics? Do I have to send them a letter through the mail for my request to be official? Are they breaking the law even though they are not making money from my graphics? Does it matter that I don't make money from my graphics? Are my original graphics copyrighted to me and what rights do I have? Thank you for your time.
