Legal Question in Landlord & Tenant Law in Oregon

eviction? no lease/rental contract

My friend own her a home that she is letting her daughter live in. The daughter let a boyfriend move in over a year ago, now they are not getting along and he won't move out of the home. Is there anyway, without a contract of any kind, to get him to move out of the home?

Re: eviction? no lease/rental contract

Yes, she can get him to move, but it can be tricky. The boyfriend is probably a "tenant" under the Oregon Residential Landlord Tenant Act (ORTLA). As a tenant, there are a number of protections for him (not for your friend).

The status as "tenant" does not require a written contract, but there is likely an oral one.

Either way, evicting someone is not something that folks unfamiliar with the law should attempt without legal advice. Doing it wrong will result in him being allowed to stay and your friend could even become liable for his attorney fees if he hires one and she loses.

Our office represents residential landlords in dealing with problem tenants. Have her give us a call.
