Legal Question in Medical Malpractice in Oregon

I have had an intermitant pain in my right side for three years. Numerous tests to try to find the problem. It was a part of the bowel poking through a hernia in my lower right side. I had surgery for the repair of it in Dec. of 2010. When I awoke after surgery I found that the Surgeon had done a different surgery in the wrong place. I still had much pain in my right side. After 10 months of this pain I had a different surgeon do the surgery in the right place this time. It is fixed now.

I feel that I have had to go through a lot of unnecessary pain because of the first Doctors carelessness. Do I have a case or not. I would appreciate an answer.
