Legal Question in Medical Malpractice in Oregon

Spinal Tap

Do I have a case if the doctor that did my spinal tap did not leave me on my back for 8 to 12 hours that is required? Due to this, I had and still are having major headaches and other problems. The doctor left me on my left side after the spinal tap for 2 hours. Then made me stand up and go home. I have understood that there can be related problems for me down the road. Please let me know if I have a case.

Thank you.

Re: Spinal Tap

I am handling several medical malpractice cases. You must obtain your medical records and have another spinal surgeon review the records to determine what your specific needs were post-surgery. Then the doctor that reviews the file will give an opinion if the operating doctor's performance fell below the standard of care expected from other doctors practicing similar types of medicine. If your doctor fell below the standard of care, then you must additionally prove that the cause of your problems were related to the doctor's malfeasance of his responsibilities. It can cost between $600 and $1000 to obtain all of your records and pay for another doctor to review and give his opinion of whether you have a case against your doctor.
