Legal Question in Personal Injury in Oregon

I have a 12 year old daughter that was in a car accident 10-2004 in california. she was with my son's girlfriend had a seat belt on a drunk driver pulled out in front of them her face went through the windshield she did not have any stiches or stay in the hospital yet miricle they walked away. from that day untill 08-2009 she refused to even speak about this, and one morning she just woke up and said ok mom lets deal with this. i contacted drivers insurance company they sent us to see a plastic surgern who said not untill she is 17 or older would he suggest fixing scars and it would be about $3000.00 to do this. so i called the insurance person we r dealing with and they offered a settlement of $22207.00 that would be 2500.00 now then 4000.00 on 18th bday, 5000.00 on 21st b-day and balance of 10701.00 on 25th b-day. my daughter still gets glass out of her forehead and still has a hard time speaking about this. do you feel this is a fair amount? and not ever dealing with anything like this b4 i'm not sure if i should ask for more or what. any advice anyone could give me would be great. thank you for your time

Law pertaining to accidents and personal injury can be different in each state, so you should definitely consult a California attorney. Your daughter can press her claim now, because she was a minor at the time of the accident. She has 2 years after her 18th birthday to file suit. I would say that the amount offered in settlement is much too little. Consult a California attorney who specializes in auto accidents or other personal injury cases.
