what is average settlement time for injury/accident when fault has already been established.

Every personal injury lawyer gets asked this question. The answer is, of course, it depends.

Generally, we want our clients to be medically stationary before we think about trying to settle, since we can't have any fair sense of the value of the case until the treating doctors can give us a reasonable prediction for the future. That can take a year or more, or it can take two months. Then, once the client is stationary, we still have to get all the medical records and billings and submit them to the insurance company as part of a settlement package with a demand letter. Just getting all the records can sometimes take months.

There may be other factors applicable to your particular case as well which may be slowing the settlement process.

The fact that fault has already been established, as you said in your case, is besides the point. Now, as to vehicle damage, that's another matter. That's usually handled promptly and completely separately from the injury claim as soon as possible after the accident, and after fault is established.
