Legal Question in Personal Injury in Oregon
"defense"
How do you find a lawyer if you are being sued?. If you have no funds for legal defense and arent sure about the nature and validity of the case against you, are there lawyers who will consult for free?. There is someone who is accusing us wrongly of our dog having bit her. She already had a wound on her leg and is inconsistant in her story. Can her medical records be accessed? She is suing a ridiculous 10,000$ solely for personal anguish. What defense do we have?

Re: Dogbite Injury / Finding a Lawyer
If you have either HOMEOWNER'S or TENANT'S insurance, it will almost surely cover a dogbite claim. They will either hire a lawyer to defend you, or negotiate and pay the claim. Contact your insurance company IMMEDIATELY, and give them a copy of the lawsuit. You MUST file a response to the lawsuit within a limited period of time (probably 30 days) -- there should be instructions as to the time limit on the Summons, attached to the complaint that was served on you. If you wait beyond that date, you could have a default judgment entered against you. If you have NO HOMEOWNER'S or tenant's insurance, contact a lawyer immediately, and pay the consultation fee if you must. But, depending on what town in Oregon you're in, there is probably a Legal Aid (Oregon Legal Services) office nearby, who can direct you to either free or low-cost advice. If not, call the Oregon State Bar Lawyer Referral Service, at 1-800-452-7636, and ask about low-cost or free legal help. From what you've said, you have defenses to this claim, and yes, your lawyer can access any medical records related to this alleged injury, if there are any.
Good luck.
