Legal Question in Personal Injury in Oregon

so i was driving uninsured. i just paid the car off late on friday last month and got it in my name. i wasnt able to get to an insurance company before closing time. i took a fishing trip the next day and got into a wreck. i was 100% not at fault for the accident. the other was cited for being at fault. i got a ticket for driving uninsured. and i just found out that my license will be suspended for a year. i am the main driver for my house hold. and people depend on me to drive for them. i have an elderly grand mother and neighbor i help out. i have count on the 18th. thats this wednesday, and i was wondering if there is anything i can do to get it suspended for less time or get the suspension removed all together? i would really appreciate the advice. thank you for your time. sincerely, Zach Crates.

I'd recommend a lawyer I know named DENNIS KOHO. You can look him up at the Oregon State Bar's website, www.osbar.org, and click on the member directory. Dennis was a DMV hearings officer, and he often made decisions regarding suspensions. Now, he's a lawyer in private practice. Tell him I sent you. He can also talk to you about getting a hardship permit, to allow you to perform the essential services it sounds like you provide to two people.

By the way, if the accident wasn't your fault and the other party is insured, you ought to get them to pay you either repairs, or if that exceeds the value of the vehicle, they'll "total" it, and you'd get the fair market value of the vehicle, although you'll want to find comparables online, so you can be prepared for typical lowball offers. I presume that, fortunately, you weren't hurt. If you were, there are other issues related to that, and I believe Dennis can help you with that as well.

Best of luck to you,

Sam Hochberg
