Legal Question in Personal Injury in Oregon

Who is liable for damages that exceed the policy limits in a no fault car accide

At the time of the accident (1year and 9 months ago) I was the policy holder of automobile insurance. It contained insurance for two seperate cars, one my boyfriend drove and one I drove. My boyfriend was involved in an accident, and was the only person in the car. A person suddenly made a right hand turn causing the person behind him (the one with the medical claim)to slam her brakes and in turn my boyfriend rear ends her. Cops came, no tickets were issued, and everyone walked away with no visible injuries. My insurance paid for damages to our car, and that was the end of that. Until today, when I received a letter from my insurance company letting me know that the medical claim the woman my boyfriend rear ended exceeds my policy limit of $50,000. They advised me of my right to hire an attorney. My boyfriend and I are no longer together. The policy now is under my name only, and includes my car alone. Am I liable for this person's medical costs along with my boyfriend?

The situation you describe is sufficiently serious that you need to consult an attorney. Try the Oregon State Bar lawyer referral service.

For more information, contact the LRS at 503-684-3763 or toll-free in Oregon: 800-452-7636.

You are not liable for anyone's damages, until someone sues you and wins.
