Legal Question in Personal Injury in Oregon
My son was recently in an accident. He had an injury that required me, his mother to help with his daily duties. We see that there is "loss of services" that he has on his insurance company that he is entitled to? I'm self employed, which is how I have the flexiability to care for him. However he's unemployed so he can't actually pay me the $30 @ day that is allowed on his policy.
We were under the impression that he could collect his "loss of services" by a sworn affidative from myself and he could then pay me, once the insurance has paid. However we are being told that this is not possible or we will be highly scruntinized by the insurance company. Our feeling is, I did in fact take care of his needs, the fact that I'm his mother, should that matter. I do not see anywhere that it says it has to be a nurse or nurse's aide or that you have to pay immediately out of pocket.

You are being misled by the insurance company, which wants to minimize the cost to itself.
