Legal Question in Real Estate Law in Oregon
My boyfriend and I own a home together. I am moving out of the house, and we have agreed on an amount of money to buy me out. I will not get all the money up front. How can I get a legal and binding agreement? We plan on filing a quit claim deed, and he will take over the mortgage under his name only (We have contacted our mortgage holder).
Thank you for you help. Susie

Best action would be to hire a lawyer.
Second best would be to use a legal form produced by the local law publishing company, Stevens-Ness. I would think that this form would work:
Form Detail
Form Number: 704
Form Title: Real Estate Contract, Partial Payments
Publisher: Stevens-Ness Law Publishing Co.
The form is designed for use in Oregon
You can preview and buy it at http://www.stevens-ness.com/store/detail.cfm?fID=438
Of you can go to the nearest Stevens-Ness store downtown and get that form or ask if there is a better form for your situation.
The forms are also available elsewhere in Oregon. Go to http://www.stevens-ness.com/dealers.cfm?userLoc=97204 for a list of locations (or enter your own zip code in the URL, instead of 97204).
