Legal Question in Real Estate Law in Oregon

I own a house and have been living with a man who pays the utilities (his name is not on the house though). He's a sociopath and has since threatened me with a gun and I want him out. I've moved out of the house out of fear of my life. I gave police consent to enter my home to boot him out but they can't enter without a warrant and the burden is too high to justify exigent circumstance. This man is denying he did anything and says he'll only move out if I pay him $32k+. Is there any way I can legally evict him/boot him out of my home? The only thing his name is on is the utilities.

You say you own the house. That is enough. Send your "tenant" a 24-hour eviction notice. You can tack it to the front door; take a photo of it there. Or you can mail it. Then You then file a lawsuit for forcible entry and detainer. Here are very detailed instructions: courts.oregon.gov/Clatsop/docs/FEDInstructions.pdf.

Your tenant will no doubt not show up in court, so you will win. Then the Sheriff goes to the house and physically boots him out and arrests him, if he resists.

There are forms in the law itself; see http://www.leg.state.or.us/ors/105.html.
