Legal Question in Real Estate Law in Oregon

Land Sales Contract Eviction

Can I file an FED on a extremely

defaulted land sales contract without

hiring an attorney, by myself? How

do I go about doing this? Do I pick

up papers somewhere? I am

desperately trying to help my very ill

grandmother who owns the property

but no longer even lives in Oregon.

anything would be helpful and a

blessing. Thank you so much for

your time.

Re: Land Sales Contract Eviction

The process for recovering property under a defaulted land sale contract takes two steps. First the contract has to be foreclosed, then the occupants evicted. You cannot evict the occupants until the contract is properly either (1) forfeited or (2) foreclosed upon.

This is not an area for do-it-yourself. To properly clear the title and get it back in your grandmother's name requires a variety of legal steps and takes 2-5 months.

Once the property is back in grandmother's name, the occupants can be evicted through the court system using an FED.

Our office regularly handles contract foreclosures and forfeitures for clients. We also offer a low cost initial consultation.
