Legal Question in Real Estate Law in Oregon

Minor living with adult sibling

I'm trying to move in with my sister in her apartment. Her landlord is trying to prevent this, making excuses. First, is it legal for me to move in with her (I'm 17, she's 22). Second, is it legal for the landlord to forbid me to live there (barring anything in the contract that obviously answers that question). Third, can this be used in the laundry list of things wrong with the apartment in order to break the lease? Thanks!

Re: Minor living with adult sibling

It is likely that your sister's lease with the landlord specifies who may live in the apartment and prohibits subleasing the apartment. If the lease contains that kind of language the landlord is entitled to prohibit you from moving in.

Landlords are not required to permit extra people, who were not part of the original application, to move into their apartments.

The landlord's refusal to allow an additional person to live in the apartment cannot be used to break the lease. If your sister breaks the lease because the landlord will not let you live there, she could be liable for breaking the lease and could have to pay rent for the entire term of the lease.
