Occupancy Number for Leasing an Apartment

Quick questions. What is the maximum number of occupants by oregon law allowed in a 2 bed room apartment? How many Adults? How many children?

My wife and I have a 3yr old, a 2yr old and a 2 month old. We want to move into a 2 bedroom, I am told we can until the 2 month old is 12 months old. Can infact 3 children and 2 adults occupy a 2 bedroom apartment by oregon law?

Oregon law provides a "safe harbor" for landlords, which allows the landlord to limit the number of tenants in one housing unit to 2 persons per bedroom (whether they are children or adults is immaterial). This means that a landlord can limit a 2 bedroom apartment to a total of 4 tenants.

Since you and your wife have 3 children, this would exceed that limit and the landlord can refuse to rent to you.
