property line adjustment

We sold our neighbor .20 of an acre for $5000. so he could put in new sewer. Our agreement was this:considering the high cost of doing survey that we would have agreement between us that whoever sold first would pay for survey. Now he has retained lawyer, reneging on our deal. What are we going to have to do to clear this up?

Is your agreement in writing?

Did your neighbor actually pay you $5000? I assume not.

If he paid, did you record your sale of .20 acre in the county property records?

Is he using the land for his sewer?

If your agreement is in writing, you can sue him for breach of contract, if he fails to pay you the $5000.

If is using the land for his sewer already, you can sue him for trespass (and breach of contract).

If you already recorded the sale on the county property records, you need to record a recission of the sale.
