Legal Question in Real Estate Law in Oregon
quit claim deed
Once I have paid my ex wife for her part of the equity in our home, I need to remove her name from the mortgage. I have been advised to get a quit claim deed. Are there any legal papers that I need to have signed or legal advise that I need to get to complete this transaction.

Re: quit claim deed
You cannot unilaterally remove your ex-wife from the mortgage. In order for her to be taken off the mortgage, you either have to refinance the house on your own, or convince your current mortgage company to release her. They are unlikely to agree to do so.
A quit claim deed will remove her from ownership in the property, but will not relieve her of liability on the mortgage.
