Legal Question in Real Estate Law in Oregon

Real Estate

I bought a home before I got married. I would now like to add my husband to ownership of the home and also legal responsibility to pay for the home. What type of form would I need to take care of this?

Re: Real Estate

You need to draft and record a new warranty deed (check the type of deed you have now) by which you transfer the ownership of the real property from yourself to yourself and your husband as joint tenants with right of survivorship or tenants by the entirety.

The two questions you need to address are (1) type of deed and (2) how you will take title. Consideration will be 0 as it is an intrafamily transfer. This will need to be recorded at the County Clerk's office.

If you want to add your husband to the mortgage you will need to talk with your lender to have him be added as an obligor under the mortgage. You may also be able to refinance and get a better rate.

I recommend letting an attorney prepare the deed as it's important to get this right.
