Regarding Rent

My husbands brother agreed to pay rent and take care of the home after their mom passed away 3 years ago. We have yet to see any money. Each time he is asked about it, he tells the siblings that he will, but it never happens. We want to get him out and get someone else into rent the place. How do we go about getting him out.

This is a somewhat complicated issue - not because it is your brother-in-law living in the house, but because you need to determine who has the right/responsibility to deal with him. In most estates, that person is the individual appointed by the court to be the Personal Representative for your mother-in-law's estate. It sounds like no one was ever given this responsibility. That probably needs to happen before anyone can deal with the brother residing in Mom's house.

Once someone has the right to deal with him, that person can evict him or take other actions to remove the brother from the house.
