Legal Question in Real Estate Law in Oregon

Un-married couple buying a house

Myself and my boyfriend are purchasing a house together. We are not married, and do not plan to marry for some time. We would like to write up a contract that explains who pays for what, who has what equity, what would happen should the relationship dissolve, etc.

What kind of document would this be? What needs to be included? Should this be written by a lawyer, or can we write it ourselves?

Re: Un-married couple buying a house

The agreement that you and your partner would be creating is a partnership agreement. I always recommend that unmarried couples purchasing a house create a contract that deals with these issues.

Our office has a multi-page outline of isses that should be considered and addressed. Your question has hit some of the highlights, but there are many more to be considered such as who lives in the house if you can no longer live together and what happens if one of you can no longer contribute to the house payments due to illness or disability.

This kind of a contract can be fairly complicated, I would not recommend that you creat it without legal assistance.

We have done many of these contracts for unmarried couples. Please give us a call. We offer a low cost 1/2 hour consultation.
