Warrant Work Completion

I built a home and took ownership in Feb of '05. According to our contract all 1 year warranty work was to be complete in or around Feb or '06. This work is still not complete. In addition it took 13 months to get someone to come out and look at water damage. During that time mold became a problem. I called, sent in online warranty requests and tried in every way to get someone to fix the problem. I finally went to the builders office and made a scene, they appologized and fixed that problem, but still have not completed the rest of the work that was written up during the walk through. We would like to sell our house and purchase new and recently had to back out of deal at our realtor's advice because we need to get the rest of the work done on our house. What are our options?

Probably the best thing to do is to send a comprehensive letter, indicating what you were promised (both orally and more importantly, in writing), what you expect to be done, and when. This will put your position in writing, and document your efforts to move things along. Have specific (and realistic) deadlines in the letter. At the end of the letter include the words, "We reserve all rights." If the letter doesn't work, then an attorney-letter should follow (unless you want an attorney to draft the letter.)
