Individual Income Taxes, US 1040, may be discharged in Bankruptcy. The returns must have been filed 3 years or more prior to filing the Chapter 7 Bankruptcy. If you filed timely, your 2004 return would not be dischargeable until April 15, 2008, or 3 years after the date of filing the return, whichever is later.
