Legal Question in Traffic Law in Oregon

Automobile Accident Settlement

Hello,

I was in an automobile accident almost a year ago now, where the lady behind me rear-ended me. I now have had neck and back tightness and soreness since the accident. I have been to Chiropractors, medical doctors, Rehab. doctors, massage therapists. I have been receiving treatment for almost a year and will be settling soon. I am wondering how much I am ''entitled'' to. I realize it would be best to get an attorney, but I'm just trying to find a ball-park range right now. I've heard that some people get three times their medical bills. My medical bills will be close to $4,000. I am not in PAIN, but suffer from constant discomfort. My neck and back ''should'' heal completely, but shoudn't I get a ''decent'' amount of money for all that I've been going through this past year?

I realize it is hard to give me an accurate estimate without all of the details, but are we talking $1,000, $5,000?....or am I way off?

Thank you!!

Re: Automobile Accident Settlement

There are many variables which must be considered in evaluating a PI claim. Your information is insufficient to provide you with an exact answer.

Generally, as a rule of thumb and not as a formula, a PI case with clear liability, no comparative fault and no other complications could be worth between $8K - 12K with hard medical specials of $4K.

It usually takes the employment of a PI lawyer to obtain a settlement in that range - the insurance companies do not take a claimant representing himself very seriously.
