Legal Question in Traffic Law in Oregon

Pariphinalia or PCS

I was returning two Marijuana pipes

to an ex-girlfriend and my friend got

pulled over.. the cop smelled pot

but they where two resonated

pipes and she gave me a 475.864

PCS for 1 oz. of Marijuana. I don't

smoke but used to and now I have

a $1000 fine when there wasn't an

ounce...should I plead guilty and

pay the $1000 or would it be better

to get the DA to change it to a paraphernalia charge?....I looked it

up on the internet and the only

laws I could find are for paraphernalia sales not ownership

of and that is $5000 and a year in

jail....did I get lucky by this or are

there ownership laws?

There are several Oregon lawyers whose practices involve a lot of marijuana work. Try John Lucy IV, or Lee Berger. Contact info for both can be found on the Oregon State Bar's website, which is www osbar dot org, then look under "member directory." You might also look for lawyers with this focus by googling up the Oregon NORML website.
