Legal Question in Traffic Law in Oregon

Screwed

Keep it short, but me and 2 other buddies were comin down the mt from snowboardingn and after a good day, we hopped in the truck and started to go home. My buddy in the passenger seat was trying to get all his equipment situated, and boots off, and didnt put his seatbelt on yet. Not even 5 seconds out of the ski parking lot a cop pulls us over for it, and gets us for 2 small bags of weed. 2 possession charges, and didnt even write a ticket for his seatbelt. he called it a warning? is this justice? He didnt even search the vehicle, we were honest from the start once he said he smelt it, and gave him our 2 super small bags, with barely any paraphennuilla.

It depends. . .

A seat belt violation can be the basis for a stop because of what the law says. Were you guys smoking MJ in the truck prior? The possession carries a minimum penalty of $250 + 1 day jail. If he charged you with possession of drug paraphenalia, that's another $250 + 1 day jail. You guys need to get a lawyer ASAP. Good Luck!
