hi, my dad passed away in oregon.he had no will.we had a falling out 6 yrs ago.i asked his wife, not my biological mom, for one thing of my dads for each of the grandchildren, there are three grand-kids. she told me no. my dad and her havent even lived together in 10 yrs. when they married she wouldnt even take my familys last name. im his only surviving child, do i even have any rights

Absolutely. If there is no will, and he was remarried, half of his estate goes to you and the other half goes to his spouse. You can file to be the personal representative of his estate. Gather all his assets that he had when he passed away, and distrobute them half to her and half to yourself.

If he owned very little, you can file a small estate affidavit. If you can afford to, you should make an appointment with a local estate lawyer and pay a consultation fee. It will be well worth it.
