Legal Question in Wills and Trusts in Oregon
Fraud/Failure to verify accounting of Estate
My mothers Will states 50/50 but my brother who holds POA and is acting as fiduciary is refusing to show me anything accounting and took possession of everything including her personal property, Real Estate, and Bank Accounts taken by Power of Attorney and liquidated prior to my mothers death. Within signing of the POA till her death 3 Months. All prevous attempts to have some supporting documents to verify a six line one page typed accounting sheet of the partial disbursement of the proceeds of her home have still gone un-answered and even though I have made several attempts the Estate still remains unfinished. Land in California has not been transferred from my dead mother into both our names yet. I have also found that the taxes on the land have not been paid since her death. He states the land is not worth the bother. Further monies are being withheld and are being refused to be released to me unless I accept the accounting. Unfortunately I cannot in all good faith sign off on the paper that states ''I agree to the accounting and that I release him from any liability pertaining to my mothers estate.'' When infact I do not agree to any accounting which I cannot verify. Please help where to I go I am in Fl he is in Oregon.

You need counsel in Oregon to examine the accounting. A deposition may be necessary.
