Legal Question in Wills and Trusts in Oregon

legal representative compensation

I am acting as power of attorney for my mother. I am handling all of her bills and personal matters. And helping her with nursing home issues and selling her home. I am also acting as landlord because I had to give my brother 30day notice to move from her home. What type of fees or rates am I allowed to charge for these services in Oregon. Or what is the typical fee for this type of service.

Re: legal representative compensation

If you charge fees for anything related to the real estate and the power of attorney you are using does not specifically identify that real estate, you are likely in violation of the Oregon Real Estate Licensing laws. These laws require that you have a real estate license for any "professional real estate activity". This is true even though it is your mother and she wants your help.

Just about anything you do relating to real estate is categorized as "professional" and requires a license, including renting or leasing it and selling it, even if all you do is find a real estate agent.

You may be able to be paid for services other than those relating to the real estate. The right to payment may be allowed (or prohibited) by the power of attorney document.
