Power of Attorney

If a husband and wife have complete power of attorney for each other, does this still apply after the death of either of them?

Re: Power of Attorney

Powers of attorney are only valid until the death of the person who has granted the power. The appointed agent only has the rights and abilities that the principal (the person appointing the agent has). Once you are dead, you no longer have these rights and abilities.

Some powers of attorney are only valid if the principal still has legal capacity.

Our office regularly assists people in creating and dealing with powers of attorney and can assist with their creation and exercise.
