probate

My husband recently died from a heart

attack we have been married for 26

years everything that we own is in his

name. Does that mean that it will all

go to probate.

It depends. There are times when we can avoid probate and other situations where it is necessary. It will depend on what assets your husband owned and their value. Oregon does have a small estate proceeding available for situations where the value of the assets is low.
