WOrkers' comp mandatory?

Depends on the state law. In many states, every employee must be covered. Other states have exceptions for certain types of small businesses, or make it optional, or allow certain executives to opt-out of the system.

You should consult a lawyer to learn about the benefits and risks involved in not being covered, and also to consider what might happen if you did suffer serious injury on the job.

The above does not constitute legal opinion and is offered for the purposes of discussion only. The law differs in every jurisdiction, and you should not rely on any opinion except that of an attorney you have retained, who has a professional duty to advise you after being fully informed of all the pertinent facts and who is familiar with the applicable law.
