Legal Question in Workers Comp in Oregon

Workmans Compensation workers rights

I was hurt on the job and went to hospital where I was admitted for 10 days. My employer said they may not pay for my bills or medication. They also told me that they will be using my vacation and sick time for loss time off work. Is this legal since I was hurt at work.

If you or your doctor's did not file a claim using either a form 801 or 827, you need to do so. You can call the workers' comp division to ask for a form and verify workers' compensation coverage for your employer. You generally have time limits in which to file a claim so do it right away.

If not completed already, complete form 801 and submit to your employer documenting the details of your injury and contact the doctor at the hospital and make sure they are notified that this is a workers compensation claim and complete an 827 first report of injury claim form and the doctor will submit the completed form to your employer's workers compensation insurer. Once notified of the claim, the insurer has 60 days to accept of deny your claim(s).
