Legal Question in Workers Comp in Oregon

Workmans componsation claim

I received a phone call today from the workmans comp division of the state of Oregon. I placed an ad 2 months ago looking for an independent contractor to help on a job for 1-2 weeks. He said he was and would provide me with his info which he did not. About day 6-7 he falls off the roof of a house that he was working alone on and my client calls me telling me that he needs to go to the hospital. I pick him up and he asks me if I have workmans comp I tell him no and so he says that he is going to tell the hospital that he fell off a friends roof. Well a week later he demands that I pay his medical bills but that he wants it in cash. He tell my biz adviser that not only does he get hi but that he wants to get cashed out and has no interest in paying medical bills. So now workmans comp is calling and Im wondering if I can be held liable this claim.

Re: Workmans componsation claim

Maybe. Depends on some factors including supervision and control. It is important to always check out the license, bonding and insurance of someone who claims to be an independent contractor. Bottom line is that if the insurer decides you're liable, you will get fined and you will have to defend.
