if a cheque is made stop payment by the account holder before the cheque is presented because the terms of the contract was not fulfiled by other party what is law for this

If a cheque is not honoured due to any reason, the party can bring criminal proceedings against the issuer thereafter court will decide whether proceeding against particular person in particular situation are triable or not. However, you are advised to file suit in civil court for specific performance of contract along with injunctions and damages to be on safer side.

It will be dishonored for sure and you can be accused of 489-F... You should take stay order against the cheque holder for encashing it.. Along with that you have to intimate the concerned SHO and senior police officials to not to lodge a FIR in case if the cheque is dishonored.. For more do consult me at [email protected]
