acquittal of person / accused for the lack of evidence or no case made out against the person, then magistrate at any stage after hearing the parties can acquit, it has its own parameters.so far 439 and 439 A are concerned the revisional powers of respective courts are in General form which leaves or does not touch the seperate extraordinary circumstances which may set aside an acquittal through its own course.
