Legal Question in Criminal Law in Pakistan
If a party has given cheque to any person for Mutan City as account of such person is opened in his city while plantif residing in Islamabad and presented the cheque in his account for encashment at Islamabad branch which has been dishonoured. FIR will be lodged in Islamabad or Multan area.
ur reply from where the cheque is dishonoured, how a common man define it the cheque is dishonoursed from Islamabad r Multan while cheque is presented for clearance in Islamabad if cheque honoured then cash received from own ank. Can we send case in counrt under 22A for registration of FIR in islamabad. or court ll declined our request. ur help plz

Its multan... the checque is of the bank in multan it is dishonored frm the same..

FIR is registered under Sec 489-F PPC. and in your case FIR shall be registered at Islamabad where u had presented the Cheque and Dishonored Slip attached by bank.
It is suggested that after obtaining Dishonour slip from bank u must sent a legal notice to person who issued the cheque and after 15 days proceed for registration of FIR. Police is bound to register the FIR if they failed to do so. Yes of course you can file a Writ under 22A-22-B Cr.PC before Justice of Peace, Islamabad The Court definitely shall direct the concern the SHO for registration of case.
