Legal Question in Criminal Law in Pakistan
I posted this question a week earlier in a different law area but haven't got any answer, now I am trying criminal category. The matter is as under:
Instead of giving a gift, I issued a cheque to my wife (mentioned her name as payee and crossed it) three years back. I had expecting some money coming to my account by the date mentioned on the cheque. My intention was not bad when I issued the cheque. When I came to know about the low balance, I requested her not to present the check until I ask her to do so. Anyway, she presented the cheque without my knowledge and then as expected it was bounced. Anyway, I did not know this fact that my check had been bounced. Later, after a month, I purchased Jewelery for her as a gift and the receipts of which are with me. I forgot the fact that she has my bounced cheque.
Later on, the situation of our marriage life got worsened, and I proposed her to be separated. I do not say that there is no fault from my side in keeping the relations under control, but, but largely she is responsible to bring the situation to this end because of her very bad behavior with me and my parents.
We have three children and I have proposed her to either give the custody to me or keep the children and I will give you their maintenance until each of them reaches 7 years of age regularly. Everything was being resolved out the court. Now she is threatening to file a criminal suit against me under section 489-F, based on the bounced cheques have three years earlier date. She and her parents are asking a handsome amount of money in return of the bounced cheques.
I have not contacted any lawyer till now as I was not in favor of brining disputes out of home, but this new situation has bothered me so much that now I am planning to contact a lawyer. By the way, I have not divorced her till now and I pay her regular maintenance in the form of bank transfers.
Since I am unable to meet their demands, someone told me that it's a severe criminal offence with fines and / or jail. Kindly advise as how to get out of this situation. After this threat, even one percent chance of reconciliation has vanished and I do not want to live with her anymore.

If it was just a gift than no criminal case lies against you. It is a crime only when the cheque was issued against any financial liability
