Legal Question in Criminal Law in Pakistan
If private complaint is admitted under 489f and 420, 468, 471, 467 & 489 is imposed with charge sheet by magistrate favouring accused. The accused party has further gone for revision for private complaint/istighasa to Addition/session judge what will be the result if he prepared fake documents like fake stop payment receipt. In general additional judge cancel the private complaint or send back to magistrate for regular hearing. In addition, what strategy should adopt by applicant in challan case before referring back the istighasa case to magistrate. Your suggestion will be appreciated.
