I m from Pak, my wife is US citizen we spend happily 1 year of our married life after an year she went back to America for her delivery and Allahamudulliah we got baby boy n now he is Mashallah 5 months old my wife belongs to Shia Muslim where as i belongs to Sunni Muslim our Nikkah was held according to Sunni laws...... Now my wife wants Khulla according to Shia fiqa (she is in U.S) without any reason, but i dnt want any kind of seperation among us bcoz i love her, now according to islamic laws if she will be succeed in taking khulla what law says about my child, how i will meet him during his infant period bcoz i have no permit to visit U.S and how U.S laws give my child in my custody

In your case A writ petition can be filed in High Court for your fundamental right to see your child and a guardian petition for the custody of child.

High Court ll issue appropriate orders and Our foreign office ll be directed for the arrangements of your Visa to US.There u can apply for the custody of child.

Guardian court ll also disposed off your petition with the direction to approach the concern courts at US. This ll help you for getting Visa.
