Legal Question in Family Law in Pakistan

I am an Australian citizen and have 2 daughters(5yrs and 1.5 yrs), also nationals. My husband is extremely self centered and unsupportive since marriage in 2006 and has been the cause of emotional n mental torture by in-laws. I tried working things out but he is not changing or being the tiniest bit more responsible. What are my legal rights if I apply for divorce. My parents reside out of pakistan but are here on vacation and I wish to go through with digorce while they are here. Will I lose my daughters? This man is so careless that even medical care is neglected for work. I am given no money and have to ask parents to support financially.

Hi,

You can file a "Khulla/Judicial Divorce" case in the family court. As your both daughters are minor so you will have the option to keep the custody of your kids after Khulla.

the divorce will go in your favor undoubtedly, as far as the custody of kids is concerned, if they are staying in Australia nothing to worry about,, but if they

or you intend to live/stay in Pakistan then battle could be started and you will need to prove that the welfare of kids lies in ur favour....

if you must than you may seek khula, so far your daughters are concerned you have the right of custody till puberty. but keep in mind once you are divorced than custody matters shall be based on two , three elements like if you marry again ,manner and style of minors future brought up etc
