Legal Question in Family Law in Pakistan

Child support/custody issues

I had a child 10 yrs ago from a man who was here on a VISA for school/work. He was from Pakistan. He left us when my son was 4 months old. He has never contacted us, or paid any child support. Is there any law that supports me obtaining child support, or can I gain legal custody of my son so that he can never come back and take him? Are there any other options that I have or can do?

Re: Child support/custody issues

under the family laws of Pakistan , a man is bound to provide maintanebce of wife and for thechildren who has or have not attain the age of majority.

if you are not divorced from him , than you can also claim the expense-maintanence of your child and of your self as well.

it is the general law that a minor when attains the age of 7 shall be given in the custody of father, provided if this is also in the interest and welfare of the minor.if a father is not at all, attended towards the needs of the minor, and remained ignorant all passed time than he is not fit to gain the custody of the minor, but it should all be done through the process of the court of competent Jurisdiction .

Parents of the child are the natural guardian ,but you can also attain the guardian ship of this child from the guardian court of Pakistan, proving that you are the fit and better parent and shall always look for the welfare of the child.

i ve given you the glimse of what is available to you, feel free to discuss in detail,if required or needs to proceed in this regard.

wish you good luck.
